Insurance/Reinsurance Public Policy

 Our attorneys have been involved in virtually every major Federal public policy matter impacting the insurance sector for the past two decades. From the creation and multiple reauthorizations of TRIA, to the various iterations of flood insurance reform, to the enactment of Dodd-Frank and the creation of the Federal Insurance Office (FIO), and beyond, we have represented insurers, reinsurers, brokers, policyholders, and trade associations before Congress and Federal agencies.

  • Major international insurer before Congress/Executive Branch on negotiation, advocacy, and implementation of numerous Federal statutes/programs, including TRIA, OPA 90 financial responsibility, CISADA and other economic sanctions laws, aviation war risk insurance, flood insurance reform, cyber insurance proposals, and climate change challenges.


  • Several international insurers on creation/implementation of Dodd-Frank Act Title V and subsequent successful efforts to secure US-EU “covered agreement” on insurance/reinsurance prudential matters.


  • Several insurers/reinsurers in connection with Treasury Department listing as an eligible issuer of surety bonds.


  • Commercial policyholder group in connection with the creation of TRIA and each subsequent reauthorization.


  • Commercial policyholder group in connection with potential federal response to pandemic risk.


  • Major credit rating agency with respect to state insurance departments’ treatment of proprietary credit scoring models.


  • One of the world’s largest managers of money market mutual funds in advocacy before the NAIC to obtain “cash equivalency” treatment of its products.


  • Major financial services trade association in connection with the insurance modernization studies/reports.


  • State-level catastrophe risk pool in devising federal legislative proposals to improve balance sheet resiliency. 


  • Large insurance brokerage in connection with regulatory due diligence on several major acquisitions.
